By creating a CheckNuh account or using the app or our website, checknuh.com, you agree to these Terms. If you don't agree, please don't use CheckNuh.
1. What CheckNuh is
CheckNuh is a marketplace platform that lets businesses list items for sale and lets customers find and contact them, starting in Jamaica. CheckNuh is not a party to any transaction between a customer and a business — we don't process payment for the goods themselves, take a cut of the sale, hold inventory, or guarantee delivery. Customers and businesses deal with each other directly for the items listed; CheckNuh provides the marketplace, search, and messaging that connects them.
Browsing and searching CheckNuh is free, and needs no account. Creating an account is free too, and is what lets a customer message a business, call them, get directions, and save listings.
Selling requires a paid plan (see Section 7) — a business needs an active Basic, Plus or Pro subscription to post listings. Those plans also set the business's rate for the Photo Studio, our optional professional product-photo add-on, and Pro additionally unlocks Business Intelligence. These are services CheckNuh itself provides and charges for, distinct from the customer-business transaction.
2. Eligibility & accounts
You must be at least 18 years old to create a CheckNuh account.
You're responsible for keeping your password confidential and for all activity under your account.
You must provide accurate information when registering, including a real, working email address.
One account per person. Creating multiple accounts to evade a suspension or a plan limit is a violation of these Terms.
3. Business responsibilities
Listings must accurately describe the item — its condition, price, and any defects.
Product photos a business takes or uploads itself are reviewed by CheckNuh before the listing is posted, and a listing isn't shown to customers until at least one of its photos is approved. Review can take some time. We may refuse a photo that is unclear, misleading, not of the item, or otherwise breaks these Terms. Professional photos made with the Photo Studio are approved automatically.
You must have the legal right to sell whatever you list.
You're solely responsible for complying with any law that applies to what you sell (customs, licensing, product safety, tax obligations on your sales income) — CheckNuh does not verify this for you.
You're solely responsible for fulfilling the sale — delivery, condition on arrival, refunds, and any dispute with a customer.
Photos you upload must be genuine photos of the actual item you're selling, not stock images or another business's photos.
Photo rules for your own photos. Each photo must:
show one product only. Different colours or sizes of that same product may be shown together; for clothing, a shirt, pants, shoes and a belt may be shown together as one outfit;
be clean: in focus, well lit, on a plain, tidy background, with no other items in the shot;
be labelled on the photo with the brand and product name and its key details, such as size, colour or storage. A price shown on the photo must match the listing price;
contain no phone numbers, links or watermarks.
Photos that don't meet these rules are sent back without the listing being posted.
Verification. Before posting, every business owner sends a photo of their government ID, or, only if they can't present ID, their business registration certificate from the Companies Office of Jamaica. Every business is cross-referenced with its registration at the Companies Office of Jamaica, and we may refuse or remove a business whose details don't match.
4. Customer responsibilities
You're responsible for evaluating a listing and a business before completing a purchase directly with them.
CheckNuh does not inspect items, verify businesses' claims, or guarantee any listing's accuracy — use the same judgment you would buying from any independent business.
Report a listing or business that looks fraudulent, misleading, or that sells something illegal (Section 8) — this keeps the marketplace trustworthy for everyone.
5. Prohibited conduct
You agree not to:
List or attempt to sell anything illegal, stolen, counterfeit, or that violates a third party's rights.
Harass, threaten, or abuse another user, in a listing, a message, or anywhere else on CheckNuh.
Post spam, scam listings, or attempt to defraud another user.
Use the messaging system to send unsolicited advertising unrelated to an actual listing.
Attempt to bypass, disable, or interfere with CheckNuh's security, rate limits, or moderation systems.
Scrape, copy, or resell CheckNuh's listing data or search results in bulk.
Impersonate another person or business.
6. Your content
You keep ownership of the photos, listing descriptions, business details, and messages you post on CheckNuh. By posting them, you grant CheckNuh a license to display, store, and process that content as needed to operate the app — for example, showing your listing photos to customers, or sending your product photos to the Photo Studio's image-processing provider when you ask us to enhance them. This license ends when you delete the content or your account, except where we're permitted to retain it under our Privacy Policy (for example, a message you sent may remain visible to the person you sent it to).
Other stores' listings
Some results on CheckNuh are listings from other stores that don't sell on CheckNuh. They're marked with the store's name and Visit Site, and open on that store's own website, where the item is actually sold.
CheckNuh doesn't own them. The product names, descriptions, prices, photos, logos and trademarks in those listings belong to the store that published them or to their respective owners, not to CheckNuh.
Photos in those listings are shown from the store's own website. CheckNuh claims no rights in them and doesn't offer them for anyone else to use.
Showing a store's listing doesn't mean CheckNuh is affiliated with, sponsored by or endorses that store or its products, and CheckNuh doesn't sell those items.
Prices and availability are set by each store and can change at any time. Always check the store's own website before you buy.
If your store's listings appear on CheckNuh and you'd rather they didn't, you can ask us to take them down. This is for the owner of the store or website, or someone acting for them.
What you can ask for: one or more listings corrected or taken down, or your whole store removed from CheckNuh.
How quickly: we aim to act within 2 business days. We may contact you to confirm that you represent the store.
It stays removed: a listing that's taken down doesn't come back, and a store that's removed stops appearing on CheckNuh altogether.
Asking is free.
The CheckNuh name, logo, app and website design belong to CheckNuh.
7. Subscription plans & payment
A paid plan is required to post listings. Basic is US$5 per month, Plus is US$10 per month and Pro is US$30 per month — each an auto-renewing monthly subscription billed through the App Store's or Google Play's in-app purchase system, and subject to that platform's own billing terms in addition to these Terms. Basic lets a business have up to 50 listings posted at a time and Plus up to 150; Pro has no listing limit and includes everything in Plus, plus Business Intelligence and CheckNuh's lowest photo rate.
Photo Studio (professional product-photo generation) is a separate optional add-on, billed per finished professional photo (each made from the business's own photos of the item) — never required to list, and available on any plan. The standard rate is US$0.49 per photo, including on Basic and Plus; on Pro, every photo is US$0.29 with no monthly limit. The app shows the exact price before you confirm. Photos are paid for in the app through the App Store or Google Play before they're made. Up to 10 photos per request. If making the photos fails after you've paid, what you paid for is kept for your next request.
To protect your card, every Photo Studio purchase is confirmed with a one-time code we email to your account, and a purchase that would take your Photo Studio spending past US$150 within 12 hours is held until our team has contacted you and confirmed it. Monthly plan renewals don't need a code.
Subscriptions renew automatically for the same period and price until you cancel, through your Apple or Google account settings — not from within CheckNuh. Cancel at least 24 hours before the current period ends to avoid being charged for the next one. You'll be charged through the payment method on file with Apple or Google.
If a plan lapses without renewal you can no longer post new listings, and after any applicable grace window your existing listings are hidden from customer search until the plan is active again.
A subscription can only be canceled through that platform's own subscription settings — CheckNuh cannot cancel or refund it on your behalf. You keep your plan's benefits until the period you already paid for ends, with no refund for the remaining time.
Purchases are made only in the CheckNuh app. Our website shows plans and prices for information but never takes payment, sells subscriptions, or asks for card details.
Photos you upload to the Photo Studio, on the website or in the app, are free to upload and are kept for 15 days. Any not turned into professional photos within that time are deleted automatically.
Prices are shown in the app before you're charged. We do not store your full payment card details — Apple or Google process payment directly.
CheckNuh may issue a coupon code granting a specific business free access to Basic for a set period, at our discretion. A code is single-use and tied to the first account that redeems it; it carries no cash value, can't be transferred or resold, and when it expires the normal plan requirement above applies again.
Businesses who were already listing on CheckNuh before the plan requirement took effect keep their existing access, and are not required to subscribe to continue listing.
Buying, browsing and searching remain free — the plan requirement applies only to businesses posting listings.
8. Reporting, blocking & enforcement
You can report a listing, a message, or a user directly from the app. You can also block another user, which hides their listings and messages from you. We review reports and may remove content, suspend, or permanently ban an account that violates these Terms, at our discretion, with or without prior notice for serious violations (fraud, illegal goods, harassment).
9. Disclaimers
CheckNuh is provided "as is," without warranty of any kind. We don't guarantee the app will be uninterrupted, error-free, or that any listing, business, or customer is trustworthy. Some results come from other stores that don't sell on CheckNuh. Only businesses registered on CheckNuh can be messaged or called through CheckNuh; other stores are contacted on their own websites. We don't control those businesses, don't own their listings or photos (see Other stores' listings), and aren't responsible for their listings' accuracy, availability, or fulfillment.
10. Limitation of liability
To the fullest extent permitted by law, CheckNuh is not liable for any dispute, loss, or damage arising from a transaction between a customer and a business, or from your use of the app. Our total liability to you for any claim is limited to the amount you paid us (if any) in the 12 months before the claim arose.
11. Termination
You can stop using CheckNuh and request deletion of your account at any time (see our account deletion page) — your account is deactivated immediately and permanently erased 7 days later. We may suspend or terminate your account for violating these Terms, and may discontinue the service, in whole or in part, at any time.
12. Governing law
These Terms are governed by the laws of Jamaica, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of Jamaica, unless otherwise required by local law where you reside.
13. Changes to these terms
We may update these Terms from time to time. We'll update the effective date above, and for significant changes, notify you in the app before they take effect.
